Noroozi PC Defeats Four of Five IPRs in Major LED Battle

In June 2019, the International Trade Commission instituted an investigation brought by Noroozi PC on behalf of Lighting Science Group Corp., a pioneering company in the LED lighting industry, against a number of the leading companies in the LED packaging and luminaire industry. 

Two of the largest respondents, Nichia and Osram, responded by filing five IPR petitions against the three patents in suit. The eight other respondents--Lumileds, Cree, Acuity, Signify, GE, Current, Ledvance, and Leedarson--relied heavily upon those IPRs in forming their invalidity arguments in the ITC investigation. 

In a series of decisions this month, the PTAB rejected four of the five IPRs (80%), refusing to institute any IPRs as to two of three patents in suit. See IPR2019-01260, -1261, -1487, -1488. The PTAB's reasoning further undermines a number of respondents' litigation arguments.

With these decisions, Noroozi PC has now obtained twenty non-institution decisions in favor of patent owners in IPR proceedings.
